PAPAYA FILMS FILM SET AND PHOTOSHOOT RULES

We want to provide everyone with the best working conditions on our film sets and photoshoots.

We believe that common observance of the following rules will allow this.

These rules apply to everyone present on the Papaya Films film set or photoshoot.

If you ensure the presence of other persons on the shoot (e.g., your subcontractors), familiarize them with these rules.

Your presence on the shoot is understood as acceptance of the rules.

General rules

  • Follow the safety instructions of the set manager and the production manager.
  • Address your questions and comments to the set manager.
  • Follow the security rules outlined in the risk assessment.
  • If you didn’t get the risk assessment yet, ask the production manager or the set manager for it and get acquainted with this plan before you arrive on the set.
  • Follow the health and safety as well as fire safety rules of the shooting location.
  • Segregate waste according to the instructions available on the shoot.
  • If you have symptoms of an infectious disease (e.g., sneezing, coughing), bring and wear a mask or use other necessary personal protective equipment, so as not to infect other people.
  • Our productions are always insured, but in cases not covered by the insurance we may require you to reimburse the cost of repairing any damage that you cause in the photos (e.g., scratching the floor, damaging the equipment). You are responsible to us for all such damages.

Participation in the "making of"

We can publish photos and videos made on the shoot in which you can be seen.

  • We like to praise our successes, so as you come to the set you consent to distribute your image (right of publicity, including silhouette, voice) and statements in photographic and film "making of" materials ("Behind-The-Scenes", "Case Study") recorded on the shoot.
  • "Making of" materials may be published on the Internet (e.g., social media, newsletters) and in marketing materials by Papaya Films, our client and other entities producing the shoot, without territorial and time restrictions.
  • This consent is given free of charge.

Confidentiality of information

Do not disclose confidential information to others.

Do not publish photos, videos or other stories from the shoot yourself, even on private channels.

  • Keep confidential information (as defined below) secret and do not disclose it to anyone without our written consent. You may use confidential information only to execute our cooperation, always minimizing access to confidential information. These obligations are unlimited in time.
  • Secure confidential information against access and unlawful use by other people (e.g., phone or computer access passwords, keeping documents locked).

Confidential information” is any information made available to you regarding the shoot, the produced project and the related campaign, e.g., regarding scripts, treatments, produced content, identity of the persons on the shoot and invited guests, project schedule (e.g., release date), budgets, your and other persons’ remuneration for cooperating on the project, other information that is a secret of Papaya Films, our Client or other entities cooperating on the project as well as information that could damage the reputation (in public opinion or in specific person’s) of Papaya Films or the Client.

Confidential information is not information that has been published without breaching confidentiality obligations.

Ethical principles

  • Both we and you must comply with the Code of Ethics for Papaya Films’ Partners, available at: papaya-films.com/code-of-ethics.
  • Serious violations of the Code of Ethics constitute improper performance of your duties.

Personal data

  • We process the personal data provided to us in accordance with the privacy policy available at: papaya-films.com/privacy-policy.

Detailed definitions and terms

  • The above rules ("Rules") bind all contractors ("you”) of Papaya Films (“Papaya Films" or "we") present or ensuring the presence of other persons on the film set or the photoshoot organized by Papaya Films, on preparatory works or on works performed after the shoot (the film set or photoshoot and these works are here jointly referred to as the "shoot”).
  • Taking part (ensuring the participation of another person) in the shoot after receiving Rules is treated as its acceptance. Then Rules are formally part of the contract between us and you.
  • If you participate in the shoot because we have concluded a contract with you, the content of this contract takes precedence over Rules (i.e., Rules bind you only in the part that does not conflict with this contract).
  • If it is your duty to ensure the participation of other persons in the shoot, especially your employees, associates, subcontractors, contractors or persons you represent as e.g., an agent or representative, then you undertake that these persons will also apply Rules in the same way as you, i.e. you ensure that these persons will also submit the above declarations and commitments, and Rules will apply to them as to you.
  • If you participate in the shoot because we have concluded an agreement with your representative (e.g., employer, co-worker, ordering party, agent, representative), immediately provide him with Rules.

Papaya Films

One or more of the following Papaya Films companies may be the organizer of the shoot. In the absence of other information, the organizer is a company based in the country where the shoot is organized:

  • Papaya Films sp. z o.o. based in Warsaw, Poland,
  • Papaya Films Ltd., based in London, United Kingdom,
  • Papaya Films Inc., based in New York, USA,
  • Papaya Films, Unipessoal LDA, based in Lisbon, Portugal.
